• Your actions cause harm to the platform, other users, or Gersuz’s reputation
• Such action is required to comply with legal obligations, regulatory requests, or official investigations

9. Limitation of Liability

To the maximum extent permitted by applicable law, Gersuz shall not be liable for any indirect, incidental, consequential, or special damages, including loss of data, revenue, business opportunities, or service availability.

10. Jurisdiction

These Terms of Service shall be governed and interpreted in accordance with applicable laws governing digital services and online commerce. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiations. 11. Email Sending Policy

By using Gersuz email marketing and messaging services, you agree to comply with the following sending rules and compliance requirements:

11.1 Permission-Based Sending

You may only send communications to recipients who have provided valid, explicit, and verifiable consent. The use of purchased, rented, scraped, or third-party contact lists is strictly prohibited.

11.2 Unsubscribe Compliance

All campaigns must include a clear and functional unsubscribe mechanism. You must immediately cease communication with any recipient who opts out.
Continuing to send messages after an unsubscribe request constitutes a violation of this policy.

11.3 Complaint Handling & Platform Reporting

The Gersuz platform allows recipients to report senders if unwanted messages continue after multiple unsubscribe attempts.
Accounts exceeding acceptable complaint thresholds may be reviewed, restricted, or suspended in accordance with Gersuz compliance standards.

11.4 Deliverability & Reputation Management

You are responsible for maintaining acceptable sending practices. Excessive bounces, spam complaints, blocklist incidents, or poor list hygiene may result in temporary or permanent sending restrictions.

11.5 Prohibited Content

You may not use Gersuz services to distribute content that is illegal, deceptive, harmful, or in violation of local or international regulations, including phishing, fraud, malware, hate speech, or misleading commercial communications.

11.6 Compliance With Data Protection Laws

You are solely responsible for ensuring that your data collection, storage, and processing activities comply with applicable data protection laws, including GDPR, KVKK, and other relevant privacy regulations.

11.7 Platform Integrity

Any attempt to bypass platform safeguards, including rate limits, authentication mechanisms, or security controls, may result in immediate restriction or suspension of your account.

11.8 Enforcement

Gersuz reserves the right to investigate suspected violations of this Email Sending Policy and take appropriate enforcement actions, including warnings, limitations, suspension, or termination of services.
